Terms of Service

1. Acceptance of Terms

By accessing or using Chaarmi Worlds Inc.’s products (the “Product”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Product.

2. Ownership and Intellectual Property

2.1 Ownership of Updates and Upgrades

All upgrades, updates, features, and functionalities of the Product are and shall remain the exclusive property of Chaarmi Worlds Inc. Users acknowledge that any suggestions, ideas, or requirements they propose for the Product may be implemented by Chaarmi Worlds Inc. at its sole discretion, and any resulting features or modifications shall be owned solely by Chaarmi Worlds Inc.

2.2 Product Ownership

Chaarmi Worlds Inc. owns all technology and intellectual property associated with the Product, which is developed using Unity 3D. Users of the Product do not acquire any ownership rights in the underlying technology. Users who create virtual plots of land and experiences using the Product shall retain ownership of their final creations, while understanding that Chaarmi Worlds Inc. retains ownership of the Product itself and its underlying technology.

3. User Content and Responsibility

3.1 User Responsibility

Users are solely responsible for any and all content they create or upload through the Product, including but not limited to copyrights, images, music, audio, textures, skyboxes, and 3D objects. Users agree to indemnify and hold harmless Chaarmi Worlds Inc. from any claims, damages, or liabilities arising from their content.

3.2 Disclaimer of Liability

Chaarmi Worlds Inc. provides the Product on an “as-is” and “where-is” basis. The company makes no warranties or representations regarding the quality, reliability, or availability of the Product.

4. Indemnification

Users agree to indemnify and hold harmless Chaarmi Worlds Inc., its officers, directors, and employees from any claims, losses, liabilities, damages, costs, or expenses arising out of or related to their use of the Product or violation of these Terms of Service.

5. Modifications to Terms

Chaarmi Worlds Inc. reserves the right to modify these Terms of Service at any time. Users will be notified of any changes, and continued use of the Product after such changes constitutes acceptance of the new terms.

6. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles.

End User License Agreement (EULA)

1. Grant of License

Chaarmi Worlds Inc. grants you a limited, non-exclusive, non-transferable license to access and use the Product for personal and commercial purposes, subject to the terms of this EULA.

2. Ownership

2.1 Chaarmi Worlds Inc. Ownership

All rights, title, and interest in and to the Product, including all intellectual property rights, are owned by Chaarmi Worlds Inc. and its licensors.

2.2 User Creations

Users retain ownership of their final creations made using the Product, including any metaverse galaxies, and may use them for commercial purposes. However, users acknowledge that they do not have ownership of the underlying technology or software used to create such works.

3. Restrictions

You shall not:

• Modify, adapt, or translate the Product.
• Reverse engineer, decompile, or disassemble the Product.
• Use the Product in violation of any third-party rights or applicable laws.

  
  In the event that a user violates any laws or regulations while using the Product, they agree to indemnify and hold harmless Chaarmi Worlds Inc. from any claims, damages, or liabilities arising from such violations.

4. User Content

Users are solely responsible for all content they create using the Product and must ensure that such content does not infringe on the rights of any third party.

5. Limitation of Liability

To the fullest extent permitted by law, Chaarmi Worlds Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Product.

6. Governing Law

This EULA shall be governed by and construed in accordance with the laws of Ontario, Canada.
